DERECHO DE RESPUESTA COMO FORMADOR DE OPINIÓN PÚBLICA: La jurisprudencia norteamericana y su relación con la argentina.

Recorrido breve por su obra, con motivo de su reciente fallecimiento.

Este estudio de relaciones médico-paciente en Mexico involucró entrevistas realizadas a 1700 pacientes inmediatamente de.\pués de salir de su consulta clínica. Se llevó a cabo entre los años 2004-05 en León, More ha, Guanajuato y en Charleston, West Virginia, USA. Los propósitos fueron: 1) establecer un base de datos como punto de referencia para investigaciones futuras en instituciones del cuidado de la salud con referencia a la comunicación médico-paciente, a la satisfacción de los pacientes y al consentimiento infórmado y, 2) (...) hacer una comparación entre las relaciones medico-paciente en Mexico y los Estados Unidos de America. Hicimos varias conclusiones sobre la comunicación médico-paciente, participación del paciente en decisiones con respecto a su cuidado de salud y el ambiente social de la consulta médica. Ofi-ecemos los datos y los cuestionarios completos por internet a cualquier investigador interesado para estudios futuros de acuerdo con sus propios intereses. Además, encontramos que no huho ninguna diferencia importante en las relaciones médico-pacientes con respecto al consentimiento infórmado y la satisfáccián del paciente entre México y los EEUU. En este ensayo se revisará el legado de Francisco de Quevedo y Villegas en algunos autores hispanoamericanos cuya característica común es un dominio superlativo del español: Jorge Luis Borges, Octavio Paz, Juan José Arreola y, por último, en un gran escritor de literatura y crítica que abre una veta para valorar la obra de Quevedo, la cual no fue explorada por los anteriores: José Pascual Buxó.

En el presente artículo hago un resumen de «Esas Indias equivocadas y malditas» de Rafael Sánchez Ferlosio. La principal idea que desarrolla es que el discurso de los conquistadores, y hasta la actualidad muchos historiadores, legitimaba la conquista de América en nombre de la religión, de la civilización o del progreso; por ello, todo el dolor de las «naciones indias» estaría justificado por su incorporación a la historia universal. A continuación, presento los comentarios hechos por Juan Antonio Ruescas Juárez, (...) María del Mar Ramírez Alvarado y por Francisco Castilla Urbano a ese texto ferlosiano. Finalmente, concluyo con unas reflexiones personales sobre el texto de Sánchez Ferlosio. (shrink)

We argue that deliberative decision-making that is inclusive, transparent and accountable can contribute to more trustworthy and legitimate decisions on difficult ethical questions and political trade-offs during the pandemic and beyond.

Since 2002, legislation in Spain has allowed for the creation and documentation of end-of-life decisionmaking. Over the intervening years, the actual implementation of such documents is very low. Through extensive analysis of the literature, this article explores the current status of the use of and attitudes toward advance directives in Spain and then proposes strategies for improvement in their implementation.

The ultimate source of explanation in biology is the principle of natural selection. Natural selection means differential reproduction of genes and gene combinations. It is a mechanistic process which accounts for the existence in living organisms of end-directed structures and processes. It is argued that teleological explanations in biology are not only acceptable but indeed indispensable. There are at least three categories of biological phenomena where teleological explanations are appropriate.

This paper discusses so-called post-trial access to drugs for patients who participated in clinical trials in Brazil. Brazil is currently a relevant country for the pharmaceutical industry due to the dimensions of its actual and potential market. As a consequence, the number of pharmaceutical trials has been rising. It is the largest market for pharmaceutical companies in Latin America, the 8th biggest in the world and second only to China among the so-called BRICS’s emerging countries. The demand for pharmaceutical products (...) in the country has been increasing by double digits over the last few years, reaching 20% in 2008. Not surprisingly, we are also witnessing a steady increase in the number of applications by national and international pharmaceutical companies before ethical research authorities for authorization to perform clinical trials of drugs. This book presents the reader with a comprehensive and structured understanding of the ethics of Artificial Intelligence (AI). It describes the main ethical questions that arise from the use of AI in different areas, as well as the contribution of various academic disciplines such as legal policy, environmental sciences, and philosophy of technology to the study of AI. AI has become ubiquitous and is significantly changing our lives, in many cases, for the better, but it comes with ethical challenges. These (...) challenges include issues with the possibility and consequences of autonomous AI systems, privacy and data protection, the development of a surveillance society, problems with the design of these technologies and inequalities in access to AI technologies. This book offers specialists an instrument to develop a rigorous understanding of the main debates in emerging ethical questions around AI. This paper analyses whether current explainable AI (XAI) techniques can help to address taxpayer concerns about the use of AI in taxation. As tax authorities around the world increase their use of AI-based techniques, taxpayers are increasingly at a loss about whether and how the ensuing decisions follow the procedures required by law and respect their substantive rights. The use of XAI has been proposed as a response to this issue, but it is still an open question whether current XAI (...) techniques are enough to meet existing legal requirements. The paper approaches this question in the context of a case study: a prototype tax fraud detector trained on an anonymized dataset of real-world cases handled by the Buenos Aires (Argentina) tax authority. The decisions produced by this detector are explained through the use of various classification methods, and the outputs of these explanation models are evaluated on their explanatory power and on their compliance with the legal obligation that tax authorities provide the rationale behind their decision-making. We conclude the paper by suggesting technical and legal approaches for designing explanation mechanisms that meet the needs of legal explanation in the tax domain. (shrink)

In the sport context, an essential aspect of an athlete’s development and performance happens during the interaction with the coach while receiving information on the aspects of performance that need to be modified. Grounded in the Self-Determination Theory and particularly on the basic psychological needs theory, a structural equation model was tested with the following sequence: perception of the amount of corrective feedback generated by the coach, perceived legitimacy of corrective feedback, satisfaction of basic psychological needs, and vitality in soccer (...) players. Additionally, simple mediation and serial mediation models were also tested. Participants were 377 Mexican soccer players, who completed the instruments that evaluated the study variables. SEM results reported positive and significant variables’ interrelations in the sequence. The analysis of serial mediation model showed that the perceived legitimacy of feedback and the satisfaction of basic psychological needs fully mediated the relationship between the perception of the amount of corrective feedback generated by the coach and the perception of the subjective vitality of Mexican soccer players. Results suggest that coaches have to ensure that athletes accept the corrective feedback provided and meet their basic psychological needs. Based on SDT tenets, this research highlights the importance for coaches to be aware of the athlete’s perceptions when they are providing corrective feedback and their implications for athlete’s technical development and well-being. It is suggested to incorporate those aspects to training programs for coaches. (shrink)

My purpose in this article is to propose an explicitly naturalized account of the experience of present nowness on the basis of two complementary sources: phenomenological analysis and cognitive neuroscience. What I mean by naturalization, and the role cognitive neuroscience plays will become clear as the paper unfolds, but the main intention is to use the consciousness of present time as a study case for the phenomenological framework presented by Depraz in this Special Issue.

Digital competencies were part of online education and now when returning to the classroom what will happen or what we expect for the future in education. The objective is to analyze and describe the perspectives of the level of digital competence, the non-experimental descriptive quantitative methodology is used with 1987 university students. Resulting that the instrument adapted to the Peruvian version is adequate according to statistics such as Cronbach's Alpha. Concluding that the digital competences improved the academic quality and have (...) a good level. Society is waiting for the next step to know what is presented to us in education. (shrink)

The present study aims to explore whether the symptoms associated with fibromyalgia are contextually influenced by the area of residence. Furthermore, it is analyzed whether the effect of the acceptance of the disease on the emotional, cognitive and physical symptoms is moderated by the patients’ place of residence. Using a cross-sectional design, a total of 234 women with fibromyalgia were surveyed, of which 55.13% resided in rural areas and 44.87% in urban areas. Self-reported questionnaires were used to assess pain severity, (...) anxiety and depression, functional limitation, physical and mental fatigue and acceptance of the disease. The results show significant differences in acceptance, pain, and physical and mental fatigue between patients from rural and urban areas. The rural area patients presented higher levels of acceptance and pain and lesser levels of physical and mental fatigue compared to the urban area. The moderation analysis add that, only in patients from the rural area, the variables of physical symptoms were significantly and negatively associated with acceptance. This study addresses for the first time the role of the place of residence in suffering from fibromyalgia, suggesting that the rural or urban environment plays a relevant role in the severity and/or management of symptoms in fibromyalgia women. Mixture modeling technics are not the one and only to perform person-centered analyses, but they do offer the possibility of integrating latent profiles into models of some complexity that include antecedents and results. When analyzing the contribution of socioemotional resources to the preservation of mental health, it is the variable-centered approaches that are the most often performed, with few examples using a person-centered approach. Moreover, if the focus is on the Arab adolescent population, to our knowledge, there is an absence (...) of such studies. This study aims to extend the research about socioemotional resources by examining: if distinguishable profiles can be identified based on scores about perceptions of different emotional abilities and levels of social support from different sources ; if the identified profiles relate to mental health indicators, such as depression levels and health-related quality of life ; and to acknowledge if sociodemographic variables such as age or gender and positive self-views ascertain the probability of pertaining to the identified profiles. The study was carried out on a large sample of Moroccan adolescents. We adopted a person-centered approach using latent profile analysis to establish whether different socioemotional resources profiles are present in Moroccan adolescents. Furthermore, we investigated the role of sociodemographic variables and self-esteem as antecedents of these profiles and the association of these profiles with mental health. Results from LPA revealed three patterns of socioemotional resources : “High socioemotional resources” ; “Moderate socioemotional resources” ; and “Low socioemotional resources”. Analyses showed that Moroccan adolescents differed significantly in depression and HRQoL depending on the profile membership. Profiles with higher levels of resources contributed positively to preserving mental health. Finally, the results show that self-esteem boosted the probability of pertaining to the profiles related to better mental health. Thus, this study extends previous research about socioemotional resources, highlighting that researchers and health professionals should consider empirically identified profiles of adolescents when explaining mental health outcomes. Therefore, the psychological intervention should be focused on enhancing the self-esteem of adolescents, to favor a high socioemotional resource profile, which results in better mental health. USO MEDICINAL DA MACONHA: UMA ALTERNATIVA AO DIREITO À SAÚDE.

In this paper, I engage the debate on Suits’ theory of games by providing a Kantian view of Utopia. I argue that although the Kantian aspects of Suits’ approach are often overlooked in comparison to its Socratic-Platonic aspects, Kant’s ideas play a fundamental role in Suits’ proposal. In particular, Kant’s concept of ‘regulative idea’ is the basis of Suits’ Utopia. I regard Utopia as Suits’ regulative idea on game playing. In doing so, I take Utopia to play a double role (...) in Suits’ theory of games. First, it highlights the primary condition of possibility of game-playing, namely, the lusory attitude. Second, it provides a normative criterion that serves as a critical principle to evaluate instances of game playing and as a counterfactual assumption that makes game playing possible. I provide further support for my Kantian interpretation of Suits’ Utopia by bringing to light the anthropological assumptions upon which Utopia is built. In doing so, I argue that both Suits’ theory of games, in general, and his Utopia, in particular, lay out the conditions of possibility of game playing, not an analysis on the life most worth living. Machines and Biology have been, since antiquity, closely related. From the zoological figures present in astronomical simulacra, through renaissance mechanical imitations of animals, through Decartes' wind pipe nerves, to present day discussions on the computer and the brain, runs a continuous thread. In fact, the very name of mechanism for an attitude of inquiry throughout the history of Biology reveals this at a philosophical level. More often than not, mechanism is mentioned in opposition to vitalism, as an assertion of the (...) validity of the objectivity principle in biology: there are no purposes in animal nature; its apparent purposefulness is similar to the purposefulness of machines. Yet, the fact that one picks machines as a set of objects comparable to living systems, deserves a closer look. What in machines makes it possible to establish such a connection? (shrink)

My theses are: (1) that the capacity for ethics is a necessary attribute of human nature; and (2) that moral norms are products of cultural evolution, not of biological evolution.Humans exhibits ethical behavior by nature because their biological makeup determines the presence (...) of the three necessary, and jointly sufficient, conditions for ethical behavior: (i) the ability to anticipate the consequences of one's own actions; (ii) the ability to make value judgements; and (iii) the ability to choose between alternative courses of action. Ethical behavior came about in evolution not because it is adaptive in itself, but as a necessary consequece of man's eminent intellectual abilities, which are an attribute directly promoted by natural selection. This work represents an attempt to stake out the landscape for dynamicism based on a radical dismissal of the information-processing paradigm that dominates the philosophy of cognitive science. In Section 2, after setting up the basic toolkit of a theory of minimal representationalism, I introduce the central tenets of dynamic systems theory (DST) by discussing recent research in the dynamics of embodiment (Thelen et al. [2001]) in the perseverative-reaching literature. A recent proposal on the dynamics of representation--the dynamic field approach (...) (Spencer and Schöner [2003])-- according to which the alleged representational gap between DST and representational theories of cognition needs to be bridged in order to explain higher-order cognitive activity will then be reviewed. In Section 3 I shall argue that Spencer and Schöner's attempt to bridge the representational gap may jeopardize the whole (antirepresentationalist) spirit of the DST project. In order to show why, I shall introduce the key concepts of "reliability of environment" and "primagenesis", and argue that DST can account for de-coupled, offline cognitive activity with no need of positing representational resources. That is, morally evolved as an exaptation, not as an adaptation. Since Darwin’s time there have been evolutionists proposing that the norms of morality are derived from biological evolution. Sociobiologists represent the most recent and most subtle version of that proposal. The sociobiologists' argument is that human ethical norms are sociocultural correlates of behaviors fostered by biological evolution. I argue that such proposals are misguided and do not escape the naturalistic fallacy. The isomorphism between the behaviors promoted by natural selection and those sanctioned by moral norms exist only with respect to the consequences of the behaviors; the underlying causations are completely disparate. Los artículos se corresponden con los capítulos de la segunda parte de _Los intelectuales en el drama de__ España_, el libro que Zambrano escribió y publicó en Chile en la editorial Panorama en 1937. En este trabajo se da cuenta del estado de la cuestión relativo al periodo chileno de Zambrano, se procede al estudio de los artículos encontrados, (...) sobre todo en lo que tiene que ver con su correspondencia con los capítulos de la segunda parte del libro chileno y se dan las coordenadas de su circunstancia editorial. El artículo ofrece un panorama del precedente en el Civil Law con el objetivo de distinguir los problemas que pueden presentarse en los sistemas jurídicos que tienen una práctica formal o institucionalizada de precedente, de aquellos en los que no la hay. Se identificó que se introdujo el precedente como una forma de responder a las crecientes demandas de administración de justicia en la materia y delimitar la discrecionalidad del operador jurídico. Por tanto, la tesis de fondo de este trabajo (...) es que, en la operación regular de los sistemas jurídicos del Civil Law, tanto los tribunales constitucionales y la jurisdicción en general identificaron la necesidad práctica de dotar de contornos a los derechos humanos —en tanto disposiciones jurídicas a concretar jurisdiccionalmente—.
